Dining Dilemma Scenario

Note: The author of this scenario has been a member of ASTA for 5 years and a range office/judge for NTI for the past three years.

It is Saturday afternoon and your family (Mom, daughter 10 and son 8) are enjoying lunch at the local McDonalds.  The restaurant is filled to capacity with the only table open being 10 feet directly in front of the counter.  You and your family sit down to enjoy your Big Macs.

About half way though you meal you notice two men approach the counter and one of them pushes his way through the waiting customers to the front of the line.  This man appears highly agitated.  You hear him yell at the employee standing behind the counter, “Where’s Paul the assistant manager?   I want to see him right now!”   The employee calls for the assistant manager and as he approached the counter, the man who was yelling produces a Glock 17 pistol and says to him, “Because of you I got fired, now it’s payback time!”  With those words, he shoots the assistant manager in the chest.

From your location in the restaurant it is 20 feet to either exit on your left or right: there are no exits to your rear.  There is an aluminum condiment stand two feet to the right of your table.  The stand measures six feet long by 3 feet wide.  You are carrying a SIG 239 9mm loaded with 8 rounds of CorBon 100 grain Powerball +P ammunition in a Milt Sparks Executive Companion inside-the-waistband holster, a Motorola cellphone and a 1.8 ounce canister of Sabre 5.5 OC spray.

The man who accompanied the shooter into the restaurant begins to move toward the exit to your left, stops just short of it and turns to face the dinning room of the restaurant.  After shooting the assistant manger, the shooter now turns and faces the dinning room as well with his gun still drawn.  The patrons standing at the counter are screaming and cowering and the employees behind the counter freeze in place.

What would you do?

Dining Dilemma Response

Assuming that my family & I couldn’t egress the restaurant through the right door (BG # 2 is near the left door) immediately after BG #1 produces the pistol & shoots, I would quickly move my family to cover behind the 6’ long condiment table.  I would draw my weapon & peer around the end of the table to see what BG #1 was doing.  Hopefully he did not see us & both BGs will leave the restaurant post haste.  If it appears that BG # 1 has spotted us & comes toward us with weapon in hand, I would tell him to “Stop” & any other threatening actions by him will necessitate using lethal force.  While observing BG #1, I would try to observe BG # 2 to determine if he had a weapon & what his intentions were.

If I had to shoot, I’d shoot till BG #1 was no longer a threat & turn my attention to BG #2 hoping that he would run away or comply with my commands to “Lie down”.  If he was proned out on the floor, I would cover him with my pistol while having my wife call 9-1-1 & then offer assistance to the wounded manager.  When the cops arrive, I’d have my wife meet them outside the restaurant to point out that I was the “good guy” & would put down my SIG after the cops had control of the situation & BG #2.

If the pair departed the restaurant without me shooting, I would holster my SIG & use my cell phone to call the cops then assist in providing first aid to the shooting victim.  Hopefully, between my family & the other customers, we could provide good descriptions of the BGs.
